The Environmental Planning and Assessment Regulation 2000 plays an important role in the planning provisions of the Environmental Planning and Assessment Act 1979. The Regulation is required to be reviewed and updated regularly.
A draft Environmental Planning and Assessment Regulation 2010 has been prepared for public consultation. The key features of the draft 2010 Regulation include:
- retaining most of the existing provisions of the regulation, with minor administrative changes, restructuring and an update of the numbering system
- implementing important changes to the Part 4 DA assessment system that have been the subject of previous consultation through the planning reforms program
- a number of other amendments proposed relating to fees, planning certificates, designated development, development certification procedures and other miscellaneous changes.
The draft 2010 Regulation is available for public comment until Friday, 5 November 2010.
A Regulatory Impact Statement has been prepared to accompany the draft 2010 Regulation, in accordance with the Subordinate Legislation Act 1989.
