Relevant legislation: The Minister for Planning has formed the opinion pursuant to clause 6 of State Environmental Planning Policy (Major Projects) 2005 that the future development at Breakfast Point is for the purpose of development described in Schedule 1 to that Policy (clause 13 - residential construction projects with a capital investment value of more than $50 million that the Minister determines are important in achieving State/regional planning objectives). The proposal is thus declared to be a project to which Part 3A of the Environmental Planning and Assessment Act 1979 (the Act) applies. Note: On 29 November 2005, the Minister for Planning authorised the submission of a concept plan for part of the Breakfast Point master plan area, pursuant to section 75M of the Act. A concept plan was submitted and subsequently approved by the Minister on 7 April 2006, subject to conditions. The Plantations Precinct occurs within the Concept Plan area and this proposal is to be assessed as part of the approved concept
