The Department of Planning and Environment (the Department) has prepared zoning, height and Gross Floor Area controls to the site in advance of a sale process by landowner Property NSW.
The proposal aims to change the planning controls prior to the sale, to ensure that appropriate provisions are in place to guide any future redevelopment of the site. The proceeds of the sale would be used to provide new purpose built social housing.
The amended planning controls would improve views by reducing height limits for any new building on the site. Views to and from the Opera House and the Harbour Bridge would be enhanced because the maximum building height of any new building would be restricted to the height of the Sydney Harbour Bridge deck. The Sirius building could also be kept in its current form, if that’s what the new owners choose to do.
The Department of Planning and Environment has prepared a draft State Significant Precinct State Environmental Planning Policy (SSP SEPP) to apply the following planning controls to the site:
The Sirius site is 3,640 square metres of land at 36 – 50 Cumberland Street, The Rocks and houses the Sirius building.

The amended planning controls are designed to improve views by reducing height limits for any new building on the site. Views to and from the Opera House and the Harbour Bridge would be enhanced because the maximum building height of any new building would be restricted to the height of the Sydney Harbour Bridge deck.
State Significant Precincts (SSP) are areas with state or regional planning significance because of their social, economic or environmental characteristics and are typically large sites owned by state Government.
The State Environmental Planning Policy (State Significant Precincts) 2005 (SSP SEPP) provides a framework for new planning controls on the site, and can be approved by the Minister for Planning.
The zoning change would allow for uses including residential, commercial, retail and community facilities. Existing permitted uses would not be effected. The Sirius building could also be kept in its current form, if that’s what the new owners choose to do.
The new controls could allow for a building ranging from 2 – 4 storeys and provide around 85 new apartments with ground floor commercial or retail uses.
The Department has commissioned a concept design of a building for the site as an example of what could be developed and to inform the planning controls. The concept design is shown in the urban design study, which can be found at in the Urban Design Report (Urban Design Report Part 1 - PDF, 6.6MB, and Urban Design Report Part 2 - PDF, 8.9MB).
Any application on the site for development over $10M would be subject to assessment by the Department under State Environmental Planning Policy (State and Regional Development) 2011.
A design excellence clause has been included in the draft planning controls to ensure any proposal delivers the highest standard of architectural, urban and landscape design. The clause also requires that development on the site will be considerate to the surrounding heritage of The Rocks area.
The design excellence clause means any new development over $10 million will hold a design competition, which will be considered by a design review panel. This will ensure the highest architectural quality.
The proposed planning controls would set maximum building heights across the site ensuring that any new building will be below the height of the Sydney Harbour Bridge deck. The planning controls would allow for a building that ranges from four storeys at the northern part of the site, three storeys in the centre of the site, and two storeys at the southern end of the site. These heights have been chosen to improve views to and from the Sydney Opera House and Sydney Harbour Bridge.
The planning control amendments are on public exhibition from 7 December 2017 to 16 February 2018 and feedback is invited. Submissions must be received by 16 February 2018 to be considered.
