On 20 August 2019, the Department issued a $15,000 Penalty Notice to Warkworth Mining Limited for failing to construct and manage mine water in accordance with their Water Management Plan.   During a site inspection, an authorised officer observed a pipe draining an area that receives coal contact water, which was installed in a way that meant saline water drained directly into a sediment dam. Sediment dams are designed to receive only low salinity sediment laden water. As a consequence of the pipe setup, a saline discharge occurred from sediment dam during a rainfall event on the 30 March 2019.

The Department and EPA collaborated on this investigation and the EPA have issued a $15,000 penalty notice for discharging waters offsite that exceed the Hunter River Salinity Trading Scheme limit. The Department will continue to ensure mines water management systems are constructed and managed appropriately.
