On 18 October 2019, the Department issued a $15,000 Penalty Notice to HV Operations Pty Ltd (HVO), for failing to take all reasonable and feasible steps to minimise visible off-site air pollution generated by the project. On 21 August 2019, during unannounced surveillance, operations occurring in the Riverview Pit were observed to be generating excessive dust which then left the site during high wind conditions.  The Department did not consider that operations were reasonably modified as required to reduce dust emissions. The Department will continue to monitor compliance with approved air quality operating conditions for all Hunter Valley coal mines.
