Since 2016, the Department has been investigating and working to remedy continuing breaches of the consent. On 24 September 2018, the Department issued two development control orders to Glass Recovery Services Pty Ltd (GRS) to carry out the following works at 126 Andrews Road, Penrith:

  1. Demolish the existing external storage bunkers and re-build the bunkers in accordance with the consent. The order was issued as the existing external storage bunkers used for storing sand and glass cullet (crushed glass) have not been constructed in accordance with the consent. As a consequence, glass cullet and sand has escaped around the perimeter of the external bunkers and the stockpiles exceed the height of the bunkers with a risk of the material reaching the environment; and
  2. Lodge an application under s138 of the Road Act 1993 with Penrith Council for the construction of road intersection works on Andrew road in accordance with the conditions of consent. The order was issued as a road intersection (on Andrews Road (at the entrance to the site), required under the consent for road safety reasons, ha not been constructed.
