On 5 September 2019, the Department issued a $15,000 Penalty Notice to Acciona Infrastructure Australia Pty Ltd (Acciona) for failing to comply with the Construction Heritage Management Plan for the CBD and South East Light Rail Project.
On 29 October 2018, Acciona removed human remains from an excavation pit on the corner of Elizabeth Street and Chalmers Street, Surry Hills. The removal of the human remains from the pit was not undertaken in accordance with the project’s unexpected heritage finds protocol. In particular, the remains were handled without appropriate expert heritage supervision present, and without prior notification of the unexpected find being issued to either the NSW Police, NSW Coroner’s Office or the other relevant state organisations required under the Unexpected Heritage Finds Protocol.
Acciona cooperated with the Department throughout the investigation and has taken a number of actions to ensure that a similar breach does not occur again, including implementing additional worker training, undertaking archaeological monitoring of further works and reviewing its procedures and training practices. The Department will continue to monitor compliance with the conditions of approval for the CBD and South East Light Rail Project.
