2026 April formal enforcements

(DA251-09-01) Wentworth Shire LGA

On 3 April 2026, the NSW Department of Planning, Housing and Infrastructure (the Department) accepted an Enforceable Undertaking from Tronox Mining Australia Limited (Tronox), for failing to implement the Ginko Mineral Sands Mine (Ginko) and Snapper Mineral Sands Mine (Snapper) Flora and Fauna Management Plan (FFMP), the Ginko and Snapper Offset Management Plan (OMP), and for failing to pay the required annual contributions to Wentworth Shire Council for maintenance of auxiliary roads.

Tronox has undertaken to provide $96,000 in funding to the Australia Wildlife Conservancy to be dedicated to its efforts in protecting fragile mallee ecosystems and the species that depend on them at the Scotia Wildlife Sanctuary (acknowledging that the Australian Wildlife Conservancy's work on feral predators extends beyond the 8,000 hectare feral predator-free fenced area, and directly benefits the Western Blue-tongue lizard, Bolam's mouse and Marble-faced Delma).

Tronox has addressed these non-compliances by implementing improvements to the Eastern Operations Compliance Management System to ensure ongoing compliance with the FFMP and OMP and has since paid the outstanding annual contribution amounts owed to Wentworth Shire Council. (MP07_0155) Goulburn Mulwaree Shire LGA

On 1 April 2026, the NSW Department of Planning, Housing and Infrastructure (the Department) issued a $15,000 Penalty Notice to CEAL Limited for failing to comply with the approved truck movement limit on 28 April 2025 at the Ardmore Park Quarry project. Compliance with approved truck movement limits is important to protect the local amenity for surrounding communities. The Department will continue to monitor for compliance with conditions of consent.

(SSI-7666) Coffs Harbour City LGA

On 10 April 2026, the NSW Department of Planning, Housing and Infrastructure issued a $15,000 Penalty Notice to Tunnelling Solutions Pty Ltd for failing to comply with approved blasting limit on 8 May 2025 at the Coffs Harbour Bypass project. Compliance with approved blasting limits protects the local amenity for surrounding communities. As tunnelling is now complete on the project, there is no further risk of tunnel blasting impacts.

(SSD-9439) Central Coast LGA

On 16 April 2026, the NSW Department of Planning, Housing and Infrastructure (the Department) issued a $15,000 Penalty Notice to the NSW Department of Education for failing to conduct, and submit to Council, annual ecological monitoring in accordance with the Vegetation Management Plan for 2024 at the New Warnervale Public School (now known as Porters Creek Public School). The monitoring was required to assess vegetation growth and inform adaptive management strategies for the following year. Annual monitoring for 2025 has been completed and submitted, and the Department will continue to monitor the school's progress with the Central Coast Council.

(SSI-10034) Snowy Monaro Regional LGA

On 28 April 2026, the NSW Department of Planning, Housing and Infrastructure issued an Official Caution to Snowy Hydro Limited for failing to undertake the second Independent Environmental Audit (IEA) for the Snowy 2.0 Segment Factory in accordance with the conditions of the approval. Snowy Hydro Limited are currently engaging experts to undertake the IEA.
