Exempt development
To qualify as exempt development, a driveway, hardstand space, pathway, or paving must meet all exempt development standards in the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (Codes SEPP).
You cannot build driveways on land in:
- foreshore areas
- environmentally sensitive areas
- heritage conservation areas
- draft heritage conservation areas.
You also cannot build or install them on or within a heritage item or draft heritage item.
You must construct the work so that all surface water and run-off drain into a system connected to the existing stormwater drainage system.
The work must be built in accordance with the relevant Australian Standards:
- AS/NZS 2890.1:2004, Parking facilities, Part 1: Off-street car parking.
- AS: 2890.2—2002, Parking facilities, Part 2: Off-street commercial vehicle facilities.

For the full list of development standards for exempt driveways and hardstands see Subdivision 14. For pathways and paving, got to Subdivision 28 in the Codes SEPP.
