The Department of Planning, Housing and Infrastructure assesses development proposals where the Minister for Planning and Public Spaces or the Planning Secretary is the consent authority under Part 4 of the Environmental Planning and Assessment Act 1979.
You must make your development application to the Department through the NSW Planning Portal.
Most development proposals that need approval under Part 4 of the Environmental Planning Assessment Act 1979 are assessed and determined by local councils. The Minister for Planning and Public Spaces is however the consent authority for certain Part 4 of development proposals including:
- alpine resorts in Kosciuszko
- Gosford City Centre development with a value greater than $10 million
- major advertising signs in transport corridors
- SEPP (Precincts – Western Parkland City) 2021 in Penrith Lakes Scheme on unzoned land and land zoned Employment, Environment, Parkland, Tourism or Waterway
- SEPP (Transport and Infrastructure) 2021 in Port Botany, Port Kembla and Port of Newcastle within a Lease Area, or unzoned land, or the Intertrade Industrial Park
- SEPP (Precincts – Eastern Harbour City) 2021 for various proposals
- all state significant development.
The Planning Secretary is the consent authority for certain Part 4 developments within the NSW Special Activation Precincts of Parkes, Wagga Wagga and Moree. For development proposed within the Snowy Mountains Special Activation Precinct, contact the Regional Growth NSW Development Corporation for further information.
