Development Control Order issued to Origin Energy Eraring Pty Limited

On 1 June 2025, NSW Planning issued a Development Control Order to Origin Energy Eraring Pty Limited to remove all equipment and temporary buildings being stored outside the approved development boundary for the Eraring Battery Energy Storage System (BESS), Eraring, NSW. On 23 May 2024, NSW Planning attended a site inspection at Eraring BESS and observed materials, equipment, shipping containers and temporary buildings used in the construction of the Eraring BESS, being stored outside the approved development project area, as identified in the development consent.

The terms of the Order have since been complied with. NSW Planning will continue to monitor compliance with conditions of consent.

Penalty Notice issued to Moolarben Coal Operations Pty Ltd

On 30 May 2025, NSW Planning issued a $15,000 Penalty Notice to Moolarben Coal Operations Pty Ltd (MCO) for failing to comply with approved blast overpressure limits at Moolarben Coal Mine. On 8 February 2024, a blast at the mine resulted in an exceedance of the blast overpressure limit at the Moolarben Road monitor. MCO have since put measures in place to ensure ongoing compliance with blasting limits.

Penalty Notice issued to Evolution Mining (Cowal) Pty Limited

(DA14/98) Bland Shire LGA

On 29 May 2025, NSW Planning issued a $15,000 Penalty Notice to Evolution Mining (Cowal) Pty Limited for failing to obtain a Construction Certificate for the Mining Infrastructure Area building at Cowal Gold Mine. Evolution Mining (Cowal) Pty Limited have since applied for a Building Information Certificate with Bland Shire Council.

Penalty Notice issued to Boggabri Coal Operations Pty Ltd

Narrabri Shire LGA

On 8 May 2025, NSW Planning issued a $15,000 Penalty Notice to Boggabri Coal Operations Pty Ltd (BCO) for failing to comply with the ROM (Run of Mine) Coal production limit at Boggabri Coal Mine during the 2024 calendar year. On 15 January 2025, BCO notified NSW Planning of an exceedance of the ROM coal limit of 153 tonnes. BCO have since implemented additional governance, systems and procedural actions, and controls to ensure compliance with the ROM coal limit.

Official Caution issued to Boggabri Coal Operations Pty Ltd

(MP09_0182) Narrabri Shire LGA

On 8 May 2025, NSW Planning issued an Official Caution to Boggabri Coal Operations Pty Ltd (BCO) for failing to notify NSW Planning of an incident immediately after becoming aware of it. BCO became aware of an exceedance of the ROM (Run of Mine) coal limit on 3 January 2025 and did not report the incident until 15 January 2025. BCO have since implemented additional governance, systems and procedural actions, and controls to ensure compliance with consent conditions.
