Two state environmental planning policies (SEPPs) have been repealed (cancelled). We have transferred their functions to several older planning instruments.
Clause 4 of the State Environmental Planning Policy Amendment (Repeal of Operational SEPPs) 2019 (659) repeals these:
- SEPP No 1 – Development Standards (SEPP 1)
- SEPP (Miscellaneous Consent Provisions) 2007 (MCP SEPP).
The repeal was put into action on 1 February 2020.
What does this mean?
We have transferred the function of these SEPPs to some older planning instruments that require them.
Repealing the SEPPs does change policy substantially. We have repealed them to update some:
- older local environmental plans (LEPs)
- older SEPPs.
We have done this to include comparable provisions (legal conditions) from the Standard Instrument LEP, which sets out the content and format councils use for their LEPs.
Areas covered by the Standard Instrument LEP already have the equivalent measures in place. This means local controls will replace the function of the repealed SEPPs. Both repealed SEPPs apply to lands that have been deferred from the Standard Instrument LEP applying in each local government area and a few SEPPs.
