2025 June formal enforcements

Enforceable Undertaking accepted from Shoalhaven Starches Pty Ltd

(MP06_0228) Shoalhaven City LGA

On 4 June 2025, NSW Planning accepted an Enforceable Undertaking from Shoalhaven Starches Pty Ltd, for undertaking unauthorised construction works associated with the Rail Line and Dryer Baghouse modification to the Shoalhaven Starches Expansion project. The modification had not been approved by NSW Planning at the time construction works took place. Shoalhaven Starches Pty Ltd has undertaken to:

  • Pay Shoalhaven Landcare Association Incorporated $30,000 for use towards the Shoalhaven Riverwatch Oyster Reef Project
  • Pay Shoalhaven City Council $25,000 towards the Bomaderry Creek Weed Control and Revegetation Project.
  • Pay Shoalhaven City Council $31,275 towards the Reid Park Upgrade Project.
  • Plant native trees along the boundary of Shoalhaven Starches’ Bolong Road operations to provide additional screening of the factory for the community, and plant trees along the proposed rail line extension, to the value of $68,481.86.
  • Engage a consultant to develop and deliver a training package to Shoalhaven Starches directors and senior managers, on the key requirements and responsibilities under Part 4 of the Environmental Planning & Assessment Act 1979 (EP&A Act), to minimise Shoalhaven Starches risk of future breaches of the Part 4 of the EP&A Act.

Penalty Notice issued to Dial-a-dump (EC) Pty Ltd

(MP06_0139) Blacktown LGA

On 4 June 2025, NSW Planning issued a $15,000 Penalty Notice to Dial-a-dump (EC) Pty Ltd (DADEC) for storage of waste material outside of the approved operational boundary at the Eastern Creek Recycling Ecology Park (the project). The waste material was observed by NSW Planning during an inspection of the project in March 2025. Compliance with operational boundaries is critical as development outside these boundaries has not been assessed and potential impacts are unknown. DADEC has since been granted a modification to the consent which extends the operational boundary to incorporate the waste material in question.

Penalty Notice issued to Monford Group Pty Ltd

(SSD-9550) Greater Hume Shire LGA

On 26 June 2025, NSW Planning issued a $15,000 Penalty Notice to Monford Group Pty Ltd for failing to comply with approved construction hours for the Glenellen Solar Farm resulting in a community complaint to NSW Planning. On 23 March 2025 piling works were carried out at the Glenellen Solar farm in contravention of the approved construction hours. Compliance with approved hours for projects assists in limiting potential impacts on sensitive receivers. NSW Planning will continue to monitor compliance with conditions of consent.

Official Caution issued to Griffith City Council

(MP06_0334) Griffith City LGA

On 27 June 2025, NSW Planning issued an Official Caution to Griffith City Council for failing to prepare a feasibility report for the Tharbogang Landfill and Waste Facility within 5 years of the consent being granted, as required by the conditions of consent. The feasibility report was subsequently submitted for approval in May 2025.
